While there are no ‘right’ and ‘wrong’ answers to this question, a landowner should attempt to limit and clarify the easement agreement as much as possible using addenda. The most common addenda specify the location and dimensions of the pipe and right-of-way (a map of the property specifying the location of the easement may be included), the terms and conditions for construction and site restoration, access to the property during the life of the pipeline – including maintenance and repairs, and clearly defined terms regarding compensation for the easement and damages. Lastly, everything should be in writing and reviewed by an experienced oil and gas attorney prior to the landowner signing the contract.
